Terms of Service

Whenary terms for accounts, spaces, friends, event content, guest links, public calendar links, BYOS, acceptable use, and service limits.

Agreement

These Terms govern your access to and use of the Whenary service. By creating an account, accepting an invite, joining a space, submitting an RSVP, or otherwise using the service, you agree to these Terms and the Privacy Policy.

The service

Whenary provides private-by-default shared calendars, spaces, personal calendars, friend schedule sharing, scheduling, event planning, reminders, RSVP links, public calendar links, chats, lists, polls, memories, imports, exports, and related collaboration tools.

The service is designed to make privacy practical, but it is not a substitute for professional security, legal, medical, emergency, financial, or compliance systems.

Eligibility and accounts

  • You must be old enough to enter a binding agreement and to consent to personal data processing in your jurisdiction.
  • You must provide accurate account information and keep your credentials secure.
  • You are responsible for activity under your account unless caused by our failure to use reasonable security controls.
  • You must not share accounts, bypass authentication, abuse invites, or impersonate another person or organization.
  • If SSO (OIDC) is enabled, you must comply with your identity provider's terms as well. Linking or unlinking SSO identities is your responsibility.
  • Registration may require an invite or be closed by the operator. Circumventing registration controls is prohibited.

Spaces, roles, and administration

Spaces are collaborative groups. Space owners and admins can manage members, invites, settings, calendars, retention controls, custom emojis, BYOS settings, and other space-level features. Members may see content according to role, calendar, event, and guest-link permissions.

You are responsible for the spaces you create or administer, including who you invite, what permissions you grant, what guest links you share, and what third-party providers you connect.

User content

You retain ownership of content you submit, including calendar data, event details, messages, lists, photos, custom emojis, RSVP data, notes, links, and imports. You grant us only the limited, non-exclusive rights needed to host, process, transmit, display, secure, back up, and operate that content as part of the service.

You are responsible for what you post, import, share, and link to. Disputes between users about content are primarily between those users. We do not adjudicate intellectual-property claims.

Neutral service role

The service is a user-directed coordination tool: a neutral medium, not a publisher or curator. We do not actively monitor, pre-screen, curate, edit, endorse, algorithmically recommend, or proactively review user content for intellectual-property enforcement.

Content appears because users create it, import it, upload it, invite others to it, or share links to it. Space owners and event organizers control their own groups and permissions.

We may act on accounts, spaces, uploads, guest links, or integrations only when: (a) required by binding legal process we cannot lawfully resist; (b) automated abuse controls flag conduct that threatens the service or others (spam, malware, credential attacks, storage abuse); or (c) necessary to prevent imminent serious harm. Allegations alone, including copyright or trademark complaints, do not oblige us to remove content.

Nothing in these Terms creates a duty to monitor user content. Nothing waives your ability to export your data.

Legal process and third-party claims

We comply with compulsory legal process (valid court orders, subpoenas, and similar demands) in the narrowest way we reasonably can. Contact [email protected] for service of process. Include enough detail for us to locate an account or resource without fishing expeditions.

We do not operate a voluntary copyright-takedown or intellectual-property arbitration program. Third-party notices are not orders. If you send a complaint, we may acknowledge it, but we will not treat it as proof of infringement or automatically delete user content unless we are legally required to do so.

Where a statute or court order specifically requires a notice-and-response procedure (for example certain safe-harbor regimes), we follow that procedure minimally: we require a sworn or legally sufficient claim, act only on specifically identified material, and preserve your ability to contest removal when the law provides a counter-notice or appeal path.

We do not maintain a standing policy of terminating accounts as repeat intellectual-property infringers except where a court or binding arbitration order requires it.

Acceptable use

  • Do not use the service to harass, threaten, stalk, exploit, or harm others.
  • Do not upload, share, or coordinate illegal content or activity.
  • Do not use the service for spam, phishing, malware, credential harvesting, fraud, or unsolicited bulk messages.
  • Do not attempt to bypass quotas, rate limits, storage limits, invite limits, security controls, or access controls.
  • Do not use uploads, custom emojis, event memories, guest links, ICS feeds, or BYOS routing as a file-hosting abuse path.
  • Do not probe, scan, overload, reverse engineer, or interfere with the service except as allowed by a written security testing policy.
  • Do not use the service to violate another person's bodily autonomy, privacy, or consent (for example harassment, doxxing, or non-consensual intimate images).

Privacy and security boundaries

The service uses strong practical privacy controls, but most content is not end-to-end encrypted. The server processes content so features such as reminders, search, sharing, image processing, guest links, notifications, imports, exports, and realtime updates can work.

BYOS provides user-controlled storage for qualifying space media. It does not prevent the server from temporarily processing uploads or decrypting metadata needed to operate the app.

Guest links and subscription feeds are bearer links. Anyone with a valid link may access the data exposed by that link until it is revoked, expired, or access is otherwise removed.

Uploads and media

You may upload avatars, event covers, memories, custom emojis, and other supported image files. We may validate, resize, convert, compress, strip metadata, store, cache, remove, or reject uploads to protect users and operate the service.

You must not upload malicious files, illegal content, non-consensual intimate images, or content intended to abuse storage or bandwidth.

Imports, exports, and integrations

ICS imports, external calendar subscriptions, OIDC, web push, email, BYOS, and related integrations may involve third-party providers. You are responsible for the data you import, the external URLs you connect, and the providers you authorize.

Exports and subscription feeds may contain sensitive calendar information. Treat exported files and feed URLs as private unless you intentionally share them.

Service availability and changes

We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, permanent storage, or compatibility with every device, browser, calendar client, storage provider, or identity provider.

We may change, suspend, limit, or discontinue features when needed for security, reliability, legal compliance, abuse prevention, product direction, or operational constraints.

Beta and evolving features

Some features may be new, experimental, or evolving, including BYOS, guest RSVP links, custom emojis, ranked-choice polls, imports, exports, realtime features, and retention controls. Use appropriate caution before relying on any feature for critical plans.

Plans, quotas, and fair use

The service may enforce quotas, rate limits, upload limits, retention limits, storage limits, message limits, invite controls, and abuse controls. Limits may differ for platform storage and BYOS where technically and economically appropriate.

Paid plans on the official service (Personal Supporter, Host Pro, and storage extras) may raise limits as described on the Founders page. Limits are enforced server-side.

We may update limits to protect service health and prevent abuse. BYOS users remain responsible for costs, security, permissions, availability, and legal compliance of their connected storage provider.

Paid plans and payments

Personal Supporter, Host Pro, and storage extras are optional on the official hosted service. Calendars, friends, and spaces remain usable without payment.

When billing is enabled, payments are processed through BTCPay Server (cryptocurrency, for one-time plans) and/or Stripe (card, including recurring monthly and yearly plans), as offered at checkout. Launch pricing and standard pricing are shown on the Founders page; early-supporter rates may end when announced there.

Monthly and yearly plans renew according to the payment method and plan terms. Lifetime Personal Supporter and fixed-term passes (such as Host Pro event passes) are described on the Founders page.

Gifts may cover any plan offered at checkout. The purchaser selects the plan and either a recipient username or an open redeem code. The recipient redeems after payment clears.

Cryptocurrency payments are generally final once confirmed on-chain. Card payments follow Stripe and card-network rules for chargebacks and disputes. Contact support for mistaken duplicate charges; we do not guarantee refunds for change of mind.

Custom RSVP path aliases require Personal Supporter or Host Pro and remain subject to abuse prevention, reserved-word policies, and these Terms. Host Pro tools such as multiple links per event, export, custom link thumbnails, and guest update emails require the appropriate paid plan.

Where consumer law grants a statutory withdrawal period for digital content, you acknowledge that plan benefits may begin immediately after purchase or redemption and that applicable rights depend on your jurisdiction.

Platform operations

A small allowlist of platform operators may use administrative tools for security, abuse response, billing, reliability, and responding to compulsory legal process. Platform administration is separate from space-level roles you assign inside your groups. Operators do not browse user calendars for advertising, content recommendation, intellectual-property enforcement, or data sales.

Account suspension and termination

You may delete your account through the product where available. We may suspend or terminate accounts, spaces, guest links, uploads, or access if we reasonably believe there is a Terms violation, security risk, legal requirement, abuse pattern, or threat to the service or others.

Termination may remove access to content. Some records may be retained as described in the Privacy Policy for backups, security, legal compliance, dispute resolution, or audit integrity.

Licensing, branding, and user freedom

Unless a separate written notice says otherwise, Whenary repository source code and published project materials are proprietary: all rights reserved. You may not use, copy, modify, distribute, or create derivative works without prior written permission from the copyright holder.

That restriction governs source and documentation we publish, not your calendar data. You keep ownership of your own content. We claim only the limited rights needed to operate the service. These Terms do not restrict lawful criticism, interoperability, personal backups, or exports where the product provides them.

Do not use the service name, logos, or branding in a way that implies endorsement or confuses users about who operates the service.

Third-party services

The service may depend on hosting, storage, email, push, DNS, CDN, reverse proxy, identity, calendar, backup, and security providers. Third-party services are governed by their own terms and policies. We are not responsible for third-party services you choose or configure, including BYOS providers and external calendar sources.

Disclaimers

The service is provided as is and as available. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, data availability, and error-free service.

You are responsible for verifying important dates, reminders, imports, exports, notifications, RSVP counts, and calendar sync results before relying on them.

Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, business interruption, or substitute services.

To the fullest extent allowed by law, our total liability for claims relating to the service is limited to the greater of the amount you paid for the official service in the three months before the claim or 100 USD.

Indemnity

To the extent permitted by law and only where your conduct caused the claim: if a third party sues us because of content you submitted, your misuse of the service, or your violation of these Terms, you agree to cover our reasonable direct costs and damages awarded against us. This does not apply to claims arising from our own negligence, security failures, or unlawful actions. Nothing here limits your statutory rights as a consumer where applicable.

Governing law and disputes

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the jurisdiction where the official service operator is legally organized, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes that cannot be resolved informally, except where applicable law requires otherwise.

Changes to these Terms

We may update these Terms as the service, laws, or operational practices change. If changes are material, we will take reasonable steps to notify users. Continued use after the effective date means you accept the updated Terms.
